2. Eligibility

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration
- Account Creation: To access certain features of the Service (e.g., resume creation, rolling database), you must create an account by providing accurate information, including your email address, name, and a secure password. You agree to keep your account information up-to-date.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials (email and password) and for all activities under your account. Notify us immediately at support@pro-resumebuilder.com if you suspect unauthorized access to your account.
- Account Termination: We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, fraudulent activity, or misuse of the Service.
4. Subscription and Payment
- Freemium Model: We offer a free tier with limited features and paid subscription plans starting at $5/month (Basic) and $10/month (Premium), as detailed on our pricing page. Subscription fees are subject to change with prior notice.
- Payment: Paid subscriptions are billed monthly or annually, depending on your chosen plan. You authorize us to charge your provided payment method for the subscription fee, including any applicable taxes.
- Cancellation and Refunds: You may cancel your subscription at any time via your account settings. Upon cancellation, you will retain access until the end of your billing cycle. We do not offer refunds for partial billing periods or unused services, except as required by law.
- Free Tier: Users on the free tier may have limited access to features (e.g., basic resume templates, limited rolling database entries). We reserve the right to modify free tier features at our discretion.
5. Use of the Service
- Permitted Use: You may use the Service to create, edit, and download resumes, log accomplishments in the rolling database, and contact us via the contact form. You agree to use the Service only for lawful purposes and in accordance with these Terms.
- Prohibited Use: You may not:
- Use the Service to create or distribute content that is unlawful, harmful, defamatory, or fraudulent.
- Attempt to reverse-engineer, decompile, or hack the Service.
- Use automated systems (e.g., bots, scrapers) to access the Service without permission.
- Share your account credentials with others or allow unauthorized access to your account.
- User Content: You retain ownership of the data you upload (e.g., resume details, accomplishments). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your data solely to provide and improve the Service (e.g., generating resumes, AI personalization via Grok Pro API, planned for June 2025, Task ID 12).
6. Rolling Database and AI Features
- Rolling Database: The Service includes a rolling database feature that allows you to log accomplishments over time. We store this data in MongoDB Atlas (
ProResumeBuilderCluster) and use it to generate tailored resumes. - AI Integration: Starting June 2025, we will integrate the Grok Pro API to provide AI-driven resume content generation based on your accomplishments (Task ID 12). You acknowledge that AI-generated content may require review for accuracy.
7. Intellectual Property
- Our IP: The Service, including its design, code, templates, and content (excluding User Content), is owned by Pro Resume Builder and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our IP without written permission.
- Feedback: If you provide feedback or suggestions about the Service, you grant us a perpetual, royalty-free license to use and implement your feedback without compensation.
8. Privacy and Data Security
- Privacy Policy: Our Privacy Policy (available at pro-resumebuilder.com/privacy) details how we collect, use, and protect your data, including email, name, resume details, and accomplishments.
- Data Security: We use industry-standard measures (e.g., MongoDB Atlas encryption, password hashing with
bcrypt) to protect your data. However, no system is completely secure, and you use the Service at your own risk. - EmailJS: Contact form submissions are processed via EmailJS, which sends emails to our team. See EmailJS’s privacy policy for details on their data handling.
9. Third-Party Services
The Service integrates with third-party services, including:
- EmailJS: For contact form submissions.
- Grok Pro API: For AI-driven resume content (planned for June 2025).
- Vercel and Heroku: For hosting.
These services are subject to their own terms and privacy policies. We are not responsible for their operation or data handling practices.
10. Termination
- By You: You may terminate your account at any time by deleting it through your account settings. Upon termination, you will lose access to your data, including resumes and accomplishments.
- By Us: We may terminate or suspend your access to the Service at our discretion, with or without notice, for reasons including violation of these Terms, non-payment, or suspected fraudulent activity.
- Effect of Termination: Upon termination, your right to use the Service ends. We may delete your data after 30 days, except as required by law.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.
- We are not liable for any indirect, incidental, or consequential damages (e.g., loss of data, lost profits) arising from your use of the Service.
- Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim (e.g., subscription fees).
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights (e.g., using copyrighted content in your resume without permission).
13. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
- Dispute Resolution: Any disputes arising from these Terms or the Service will be resolved through binding arbitration in California, USA, under the rules of the American Arbitration Association. You waive the right to participate in class actions.
14. Changes to These Terms
We may update these Terms at our discretion. Changes will be posted on this page with an updated “Last Updated” date. Significant changes (e.g., subscription fee increases) will be notified via email or in-app notification at least 30 days in advance.
